We are tired of seeing property buyers getting ripped off and becoming victims of the "man in the middle" scam.

Sunday in South Africa is traditionally a day for property show houses, and some readers might be considering making an "offer to purchase". This document is essential for initiating the legal process of buying a property.

It's crucial that this offer protects the buyer's interests. Often, real estate agents (who are typically appointed by the seller) may encourage buyers to use their standard document. However, you should avoid the tempation of using it (the easy way). An offer to purchase should be customised to reflect your specific terms and preferences, including reputable conveyancers to work with.

It's important that the offer to purchase is set up to protect the buyer's interests, but often the real estate agent (appointed by the seller) wants the buyer to use their document as the offer to purchase. Don't do it, an offer to purchase is the buyer's offer, and they should tailor the clauses to reflect what offer they want to make and which conveyancers they want to use.

Property purchasers are most at risk of getting scammed

The property purchaser is most vulnerable to getting scammed; as ultimately s/he has to EFT the purchase amount into a bank account. Cyber criminals use a "man in the middle" scam to intercept communications with the buyer and alter banking details so that they reflect the criminal's details. Read the recent appeal court ruling in Judith Hawarden's case; and you'll understand just how vulnerable property purchasers are.
