2. Entry Period: “Qatar Airways Reflections Contest/Sweepstakes” commences at 09:01 AM EST on 01 April, 2012 and ends at 09:01 EST on 30 June 2012 (“Promotion Period”). All interpretations of these Official Rules and decisions made by QATAR AIRWAYS relating to this promotion are final. This Contest/Sweepstakes is governed under the laws of State of Qatar and is null and void where the local laws prohibit such Contest/Sweepstakes.

3. Contest/Sweepstakes Overview: This Contest/Sweepstakes has two separate parts: a Reflections Photo Contest and a Sweepstakes. Contestants are invited to submit photos that reflect one of the Contest Themes: Amazing Cities, Vibrant Culture, Beautiful Nature or Exciting Journey. Winners of the Photo Contest will be selected from the top 120 most voted photographs after review by a panel of expert judges. Winners of the Sweepstakes will be determined by a lucky draw from all qualified entries, as described below.

Timing: This Contest/Sweepstakes has several phases. Photo Contest. Submission phase: All photographs must be submitted between 09:01 AM EST on 01 April 2012 and 9:01 AM on 30 June 2012.  Voting Phase: The photographs will be posted for popular vote between 09:01 AM EST on 01 April 2012 and 09:01 AM EST on 30 June 2012. Judging Phase: A panel of expert judges will evaluate the 120 most popular photographs, as determined by the results of the Popular Vote. The Judging Phase will occur between 01 July 2012 and 20 July 2012.  The winners will be announced on or before 25 July 2012. Sweepstakes: The lucky draw will be held on or before July 30, 2012, from all eligible sweepstakes entries received between 09:01 AM EST on 01 April 2012 and 09:01 EST on 30 June 2012. Top-rated images will be featured, at the sole discretion of the sponsor, in the inflight magazine “Oryx” with the names of the photographers.  

Judging of Photographs: Members of the public may vote for their favourite photographs at the following website <www.qatarairways.com/reflections> and <www.facebook.com/qatarairways> between 09:01 AM EST on 01 April 2012 and 09:01 AM EST on 30 June 2012.  Only photos that comply with these rules, including subject matter and technical criteria, will be posted for popular vote. The top 120 photographs will be judged by an expert judging panel according to the following Judging Criteria: Creativity (25%); Technical Excellence (25%); Composition (25%) and Ability to Reflect the Contest Themes of Amazing Cities, Vibrant Culture, Beautiful Nature or Exciting Journey (25%). The top 15 winning photographs will be those that are rated the highest by the judges, according to these criteria. The remainder of the prizes will be awarded on the basis of the number of popular votes they received during the voting phase. In case of 2 photographs receiving equal number of votes, the judges will decide the winner.

4. How to Enter Contest or Sweepstakes:

  1. Only persons aged 18 or over on the date of entry may enter the Contest/Sweepstakes.

  2. All entrants must register and create a Profile, and must agree to receive QATAR AIRWAYS promotional newsletters by email with the exception of entrants from Hong Kong who will be sent a double opt-in email and will be added to the newsletter database only if they confirm. Entrants can opt-out of receiving future newsletters at any point in time. However, all winners must be subscribed to QATAR AIRWAYS newsletters at the time of winning or they will be disqualified.

  3. Entrants may then take any of the actions below:

    1. Upload an eligible photograph for the Contest

    2. Vote on a photograph in the Contest

    3. Liking/sharing or tweeting a photograph

    4. Referring the Contest/Sweepstakes to a friend

  4. To submit a photograph in the Contest, entrants should  submit a  photograph they took that depicts on of the following themes:

    1. Amazing cities (famous buildings, city icons, events etc)

    2. Vibrant cultures (people, food, events, Eid, Christmas, Chinese New Year etc)

    3. Beautiful nature (landscape, seasons etc)

    4. Exciting journeys (Everything related to travel)

  5. All photographs must be in .jpg or .gif format, and must not exceed 5MB in size. Entrants can submit 2 photographs per category/theme during the Submission Phase. Photos submitted in the Contest, whether winning or not, become the non-exclusive property of Sponsor and will not be acknowledged nor will they be returned. 

  6. During the Voting Phase, entrants can vote up to 5 times a day, but they may vote for a particular entry only one time during the entire contest.

  7. To enter Sweepstakes: There are 4 ways to enter the Sweepstakes: 1) by submitting a photograph n the Contest; 2) by voting for a photograph; 3) by sharing a photograph; and  4) by referring a friend who then enters the promotion or creates a Profile. Each of these activities will result in one (1) entry for the Sweepstakes. Entrants may qualify for multiple entries, with a limit of 5 votes per day, a limit of 5 shares per day, and a limit of 8 photographs entered into the Contest. The number of referrals made can be unlimited, but only a referral that results in a friend voting or creating a profile will result in an entry in the Sweepstakes. 

  8. The odds of winning the Sweepstakes depend on the number of entries received.

  9. The Promotion is open only to individuals who do NOT reside in Argentina, Brazil, Cuba, Iran, North Korea, the Province of Quebec, Sudan, or Syria. If a Canadian resident is selected as a potential winner in the Sweepstakes, a skill question must be answered correctly or another winner will be selected. 

  10. Employees of Qatar Airways, and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related are not eligible.

5. Submission guidelines for Photographs:

  1. All Photographs (“Submission” or “Submissions”) must be the entrant’s original work and must not have been used or published commercially. Submissions that contain materials that are not the original work of the Contestant, or are illegible or incomplete, will not be accepted or will be disqualified whenever the Sponsor finds out their illegibility. No submission may infringe any copyright, trademark or other property right.

  2. Submissions must not include or depict any of the following: obscenity, inappropriate language, nudity, explicit sexual activity, illegal drug or alcohol use, violence, commercial products, unauthorized copyrighted or trademarked properties, including brand names and logos, private property, unless entrant has obtained a property release specific for uses specified herein, material that is hateful, tortuous, defamatory, disparaging, slanderous, libelous, or otherwise unlawful, material that violates or infringes another’s rights, including but not limited to, rights of privacy or publicity or any other intellectual property rights, material that promotes bigotry, racism, hatred or harm against any group or individual, or promotes discrimination based on race, ethnicity, sex, religion, disability, sexual orientation or age, personal identifiable information, including but not limited to, license plates, phone numbers, personal addresses, and any other content, including but not limited to, text, images, graphics, photographs, captions and descriptions, data, codes or programs that could be considered inappropriate or offensive, as determined by Sponsor in its sole discretion.

  3. By submitting a photograph, the contestants attest that they have informed any person depicted in a photograph Entry that they are submitting the Entry to the Contest and that each person depicted has agreed that entrant may submit such photograph in the Contest.

  4. Entrants may be required to submit signed release forms from each of the people appearing in their Entry (or their parent/legal guardian) at Sponsor's request. Failure to do so within time frame specified by Sponsor may result in disqualification

  5. All eligible Photographs (as determined by Sponsor) will be posted on the Application for public voting.

  6. By entering, entrants agree that their Photographs , in its entirety or any portion thereof, may (in Sponsor's sole discretion) be posted on the Application, websites, published, broadcast on television and/or used in other Sponsor-selected media.

  7. Photographs submitted will not be acknowledged or returned. Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete or damaged Entries. Proof of submission is not proof of receipt by Sponsor.

  8. Sponsor may modify or edit any Submission, at Sponsor’s discretion.  Sponsor is not obligated to use, publish or display or broadcast any Submission.

  9. Please also see additional conditions for the photo entries in Rule 11 below.

6. Prize Details:

  1. The return ticket prizes as mentioned in clause 3 are valid only on QATAR AIRWAYS flights and do not include destinations from QATAR AIRWAYS partners or code-share agreements. Winner is liable for all taxes, fees & security charges applicable to the ticket(s). Tickets may not be issued without payment for taxes & fees. The prize tickets do not entitle the holder to any mileage credit as part of the Privilege Club program. The validity period for the prize tickets may not be extended and the prize tickets may not be rebooked. The prize tickets will be issued as an etix (electronic tickets). The prize does not include travel to or from the respective departure or destination airports or any hotel accommodation. Rights to the prizes cannot be transferred.

  2. Sponsor shall have no responsibility or obligation to a Winner or potential Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the Prizes. All costs and expenses not specifically listed above as part of the Prizes are solely Winner’s responsibility. Prizes are provided “as is”. Entrants  acknowledge that Sponsor makes no warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes, including any express warranties provided by a Prize supplier that are sent along with the Prizes and any implied warranty of merchantability or fitness for a particular purpose. By participating in Promotion, each Winner grants the right to Sponsor to record, videotape and photograph the Winner (“Images”). These Images will be owned by Sponsor. Sponsor and each of its designees shall have the right to use, edit, adapt, post, stream, copy and exploit such Images, and all elements embodied therein, including any names, likenesses, voice, conversation and any other attributes of Winner’s personality and appearance, individually or with others, in whole or in part, in conjunction with other material, in any and all media now known or hereafter devised, for the purpose of trade, advertising, promotion or any other lawful purpose whatsoever, in perpetuity, throughout the world, without additional compensation, consideration, notification or permission, except where prohibited by law.

  3. There is a limit of one (1) Prize per person in the lucky draw. Entrants can win multiple prizes if the Entrant’s photo submissions are among the top-rated ones and they also win in the lucky draw.

  4. In the event of a dispute over who submitted a winning online entry, the authorized subscriber of the e-mail account or Facebook account used to participate in the Contest/Sweepstakes at the actual time of entry, will be deemed to be the entrant. The “authorized account subscriber” for online entries is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. Proof to Sponsor’s satisfaction of being the authorized account subscriber may be required by Sponsor.

  5. Sponsor will not be responsible for any federal, state, local or other taxes and any other costs and expenses associated with the acceptance and/or use of the Prizes not specifically provided for in these Official Rules. Winners are solely responsible for reporting and paying any and all applicable taxes as demanded by the local laws in the country of their residence. Sponsor will report prize winnings to local authorities as required by law.

  6. Qatar Airways Privilege Club Terms: Qatar Airways Privilege Club miles will be credited to the Privilege Club account of Winners, who must each provide a valid Privilege Club membership number in order to receive the mileage credit. Qatar Airways Privilege Club Qmiles awarded in this promotion will not count toward elite status qualification in the Privilege Club program. If the Prize Winner is not a Privilege Club member, he/she may join online at www.qmiles.com. The credited Qmiles may thereafter be redeemed in any manner consistent with the Privilege Club program Terms and Conditions, which are subject to change at any time without notice. The Qmiles prize will have no cash value. Determination of income tax liability on Privilege Club travel awards is the responsibility of the Prize Winner. Qatar Airways may, among other things, (i) withdraw, limit, modify, or cancel any award; (ii) change program benefits, mileage levels, participant affiliations, conditions of participation, rules for earning, redeeming, retaining or forfeiting mileage credit, or rules for the use of travel awards; or (iii) add travel embargo dates, limit the number of seats available for award travel (including, but not limited to, allocating no seats on certain flights) or otherwise restrict the continued availability of travel awards or special offers. Qatar Airways reserves the right to change the Privilege Club program and its terms and conditions at any time without notice. Qatar Airways may make any one or more of these changes at any time even though such changes may affect your ability to use the mileage credit or awards that you have already accumulated. Privilege Club travel awards, accrued mileage credits and special offers are subject to government regulations. Sponsor is not liable for any expense incurred as a consequence of a flight cancellation or flight delay. Travel is subject to availability and certain other restrictions, which are subject to change in the sole discretion of Sponsor. Flight schedules subject to change without notice.

7. License:

  1. All entrants submitting a photo grant Sponsor, its representatives, affiliates, licensees, successors and assigns, (a) the right, but not the obligation, to edit, adapt, reformat, rearrange, modify, combine with other material, add to and/or customize Submission; and (b) the non-exclusive, irrevocable, royalty free, right and license to exhibit, display, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, rebroadcast, transmit, record, publicly perform, create derivatives works of, distribute and synchronize in timed relation to visual elements, and or otherwise exploit, the Submissions, and/or any portions or excerpts thereof, in any manner, including advertising, promoting and publicizing Sponsor, an unlimited number of times, in any and all media, now known or hereafter devised, in perpetuity, throughout the world, without any additional liability, obligation or additional payment of any kind to entrant or any third party with or without giving credit or referring to the names of the photographers.

  2. Select Submissions deemed suitable by Sponsor, in its sole discretion, may be posted on QATAR AIRWAYS c/s website, Qatar Airways.com, contest related digital or print ads, QATAR AIRWAYS inflight magazine and in other media throughout the Promotion Period and thereafter. Entrants agree that Sponsor and/or Administrator may post the Submissions, in whole or in part with or without attribution without any compensation.

8. Winner Selection and Notification: Winners will be notified via email and/or phone call on the contact information provided by them during the account setup and will be required to confirm his/her address and other details for paperwork delivery. Potential Winners will be required to sign and return Affidavits of Eligibility and Release in order to receive their prizes, as detailed below. If a potential Winner does not meet the eligibility requirements, does not timely return the signed Affidavit of Eligibility and Release. or does not confirm his/her address within five (5) days of initial contact, the Sponsor reserves the right to award the prize to the next most voted photograph or to the back up random draw winners. The Sponsor’s decisions will be final in all matters relating to this Contest/Sweepstakes.

9. Winner Verification:
To be eligible to be declared the Winner and to receive any of the prizes, the potential Winner must sign and return the following documents promptly upon receipt from Administrator or Sponsor, according to the time frame stated in the Winner Notification. In order to be eligible to be awarded Prize.

  1. The Affidavit of Eligibility and Release releases Released Parties, Qatar Airways, Votigo Inc. and Facebook (“the Released Parties”) from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential Winner’s participation in Contest/Sweepstakes, including, but not limited to, traveling to, preparing for and/or participating in any Prize related activity, or the acceptance, possession, or use or misuse of any Prize, to the extent permitted by the applicable law; and

  2. Except where prohibited by law, a publicity release granting the Released Parties the right to use potential Prize Winner’s name, picture and/or likeness, or biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification. Entry into Contest/Sweepstakes constitutes agreement to sign such a release.

  3. If the potential Prize Winner does not sign the Affidavit of Eligibility and Releases  within the time frame specified, the potential Prize Winner may be disqualified and the Prize forfeited and an alternate Prize Winner will be chosen from the top-rated photographs and/or in a random drawing from among all of the remaining Eligible Entries. When properly executed, and providing potential Prize Winner is in compliance with the Official Rules, potential Prize Winner will be determined to be the Contest/Sweepstakes Prize Winner.

  4. Prize or Winner Notification documents returned as undeliverable will result in forfeiture of Prize. Sponsor expressly reserves the right to delay the announcement of the Winners for any reason Sponsor deems necessary. In addition, Sponsor reserves the right to select an alternate Winner in the event that any potential Winner fails to comply with these Official Rules.

  5. By participating in Contest/Sweepstakes, all Winners acknowledge that Sponsor has not and will not obtain or provide insurance of any kind relating to the Prizes and that Winners will be responsible for obtaining and paying for any life, travel, car, accident, property or other form of insurance relating to the Prizes. Winners must also complete any additional legal documents provided by Administrator or Sponsor with respect to the Prizes and return them as instructed within the time frame specified or Winner may forfeit Prize at Sponsor’s sole discretion.

10. Use of Data: Sponsor will be collecting personal data about entrants online, in accordance with its Privacy Policy. Please review the Sponsor's Privacy Policy at http://www.qatarairways.com/qa/en/privacy.page. By participating in the Sweepstakes, entrants hereby agree to

  1. Sponsor's collection and usage of their personal information for purposes set forth in Sponsor’s Privacy Policy,

  2. Sign up to the Sponsors promotional newsletters, with the exception of entrants from Hong Kong who will be sent a double opt-in email and will be added to the newsletter database only if they confirm

  3. Acknowledge that they have read and accepted Sponsor's Privacy Policy.

  4. All information submitted by entrants is being provided to Sponsor and/or Administrator and not to Facebook, Twitter or any other social media company.

11. Other Conditions for Entering Photo Contest and Sweepstakes.

  1. The photo must have been created in the past five years and be entrant’s original work. 

  2. Entrant must be the sole author and owner of the copyright of each photo entered.

  3. Source material or proof of permission to use must be made available on request by Qatar Airways.

  4. Qatar Airways does not accept any liability for the publication of any photo.

  5. Computer-generated or computer-altered images will not be accepted. Artwork and illustrations will not be accepted. Photos not relevant to the contest themes will not be accepted. Photos or images with watermarks, signatures, URLs, names and any other text additions will not be accepted.

  6. By entering your photo, you grant to Qatar Airways the non-exclusive right to reproduce it for any purpose at any time in any media with or without attribution.

  7. The winners consent to grant the Sponsor the right to use their image, name and/or photograph in any publicity carried out by Qatar Airways, without further compensation, subject to applicable law.

  8. The winning photo will be judged by voters and the judges, as detailed in these rules.

  9. Entrants are prohibited from obtaining or soliciting votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public.

  10. The use of script, macro or any other robotic or automatic devices for votes and any other means which subvert the voting process is prohibited. Sponsor reserves the right to nullify and disqualify any and all votes or an entire entry which it believes, in its sole discretion, to violate this provision.

  11. Qatar Airways’s decision on all matters relating to the competition is final. No correspondence will be entered into.

  12.   Sponsor also reserves the right to terminate or interrupt the competition at any time. This applies in particular in the event of any circumstances which disrupt the competition or prevent it from proceeding as planned.

  13. Sponsor reserves the right, at its sole discretion, to modify or suspend the Promotion or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, (b) the Promotion or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these rules, or (c) the Promotion is otherwise not capable of running as planned by Sponsor. In the event of modification or suspension, Sponsor shall award the Prizes to Winners to be selected in random drawings from among the remaining uncorrupted applicable Eligible Entries.

  14. By participating in this Promotion, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; (d) acknowledge that Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter, and (e) agree to release, indemnify and hold harmless Sponsors, Administrator, Facebook, Twitter and each of their parents, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the Contest/Sweepstakes Entities or “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Promotion or acceptance or use of any Prize or participation in any Promotion-related travel or other activity, entrant’s breach of these Official Rules or breach of any representations as contained in these Official Rules, and for any claims based on publicity rights, defamation, invasion of privacy and merchandise delivery. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Promotion, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, unintelligible and/or postage due (or any combination thereof).

  15. The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find to have made entries in such fashion. Any entrant who attempts to tamper with this Promotion in any way shall be disqualified.

  16. Disputes. Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest/Sweepstakes or any Prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State of Qatar or the appropriate Court located in Doha, Qatar; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest/Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

1time has until the 30th of April to submit its provisional reports, or its listing on the JSE will be suspended.

1time has indicated that they expect to report a loss of some 58c per share in 2011, compared to a profit of 22c/share in 2010 (the share price gained 10% on the news!).

The Bottom Line: Regular readers will recall I bought some CMH (CMH is short for Combined Motor Holdings, a share listed on the JSE, which incidentally also owns First Car Rental) at R9 in December. The share has performed superbly this year, and we sold a small portion at just under R12 a share yesterday. I estimate their value as being somewhere between R12 and R15 (see analysis of CMH).
